    CONTEST: The Europe V-Log Contest ("Contest") begins at 12:01 AM EST on April 5, 2008 and ends at 11:59 PM EST on October 1, 2008, when all entries must be received (‘Contest Period”). Sponsor: European Travel Commission, 50 West 23rd Street, 11th Floor, New York, NY 10010. Void where prohibited by law.

    ELIGIBILITY: The Contest is only open to legal residents of the 50 United States or District of Columbia who are at least 18 years old as of the date of entry. Employees of the Sponsor, European Travel Commission, Austrian Tourist Office, Belgian Tourist Office, VisitBritain, Bulgarian Tourism Authority, Croatian National Tourist Office, Cyprus Tourism Organization, Czech Tourist Authority, VisitDenmark, Estonian Tourist Board, Finnish Tourist Board, Maison de la France, Department of Tourism and Resorts of Georgia, German National Tourist Office, Greek National Tourism Organization, Hungarian National Tourist Office, Icelandic Tourist Board, Tourism Ireland, Italian Government Tourist Board, Latvian Tourism Development Agency, Lithuania State Department of Tourism, Luxembourg National Tourist Office, Malta Tourism Authority, Monaco Government Tourist Office, National Tourism Organisation of Montenegro, Netherlands Board of Tourism and Conventions, Innovation Norway, Polish National Tourist Office, Portuguese Trade and Tourism Office, Romanian National Tourist Office, Ministry for Tourism of San Marino, National Tourism Organisation of Serbia, Slovak Tourist Board, Slovenian Tourist Board, Tourist Office of Spain, Swedish Travel & Tourism Council, Switzerland Tourism, Turkish Culture and Tourism Office, National Tourist Organization, Ukraine, or any other party associated with the development or administration of this Contest (“Contest Entities”), and the immediate family (i.e., parents, children, siblings, spouse), and persons residing in the same household, as such individuals, are not eligible to enter or win.

    HOW TO ENTER: There are two ways to enter: (1)To enter Online: Visit HYPERLINK "http://www.compulsivetraveler.tv" www.compulsivetraveler.tv during the Contest Period and follow the instructions to complete and submit the entry form and short film which conveys your story of traveling in Europe (“Film”). (“Online Entry(ies)”) or (2) To enter by Mail: mail a DVD of your Film and include a 3” x 5” index card or piece of paper with your full name, address, telephone number, and email address, if any, and mail to You & Europe Contest, c/o Spring, O’Brien, 50 West 23rd Street, 11th floor, New York, NY 10010 (“Mail in Entry(ies)”). If submitted online, the Winner will be required to mail-in a DVD of their Film once selected. Online Entries must be received by 11:59 PM EST on October 1, 2008. Mail in Entries must be postmarked by October 1, 2008 and received by October 7, 2008.

    REQUIREMENTS FOR ENTRY: Your Entry must comply with the following and you (and your parent/legal guardian, if you are a minor in the state in which you reside) represent and warrant and agree:

    That all elements of your Film submitted by you are original with you and are not copied from any other work and do not infringe upon the rights of any third party and to the extent any elements were created by a third party, you own all right, title and interest to said elements which are part of your Film. If selected as a Winner, entrant will be required to submit written evidence of such ownership and rights, in a form to be determined in the sole discretion of the Sponsor (“Evidence of Ownership”).

    That you have obtained permission from any person depicted in your Film to submit the Film and to grant the rights granted to Sponsor as a condition to entering this Contest (“Third Party Participants”). If selected as a Winner, entrant will be required to submit written evidence of such Third Party Participant’s permissions, in a form to be determined in the sole discretion of the Sponsor (“Required Permissions”).•

    The Film if uploaded must be in .flv, wmv, asf, avi, mov, .3gp, .mpg, .mpeg or .mp4 format and cannot exceed 100MB in size

    The Film whether uploaded online or submitted in DVD format cannot exceed 3 minutes in length.

    Films cannot contain any elements such as nudity, graphically violent imagery, or be explicitly racial, profane, and slanderous or be contrary to the interests of Contest Entities or they will be disqualified, as determined in the sole discretion of the Contest Entities.

    OWNERSHIP OF ENTRY: Entrants retain ownership of the Films they submit; however, by entering Entrants, on behalf of themselves and Third Party Participants grant the perpetual, fully-paid, irrevocable, non-exclusive license to reproduce, prepare derivate works of, distribute, display, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use and exhibit, including the right to edit, adapt, and modify the Film, throughout the world in any manner, form, or format now or hereinafter created, including on the internet, and for any purpose, including, but not limited to, advertising or promoting the Contest Entities, all without further consent from or payment to entrant or any persons whose performances are incorporated in the Film. It is intended that the Winning Film will be posted but Contest Entities have no obligation to post any Film and any such posting will be in Contest Entities’ sole discretion. Acceptance of a Prize constitutes a waiver, on behalf of the Winner and all Third Party Participants of any claims to compensation, royalties, or other remuneration for all uses of the Film by Contest Entities or its agents that are permitted or granted hereunder. By participating in the creation of a Film, all Third Party Participants are deemed to make the representations and agreements set forth in these Official Rules and may be required to execute documents to that effect before the selected Winner is entitled to receive any prize. Should any Third Party Participant fail to comply with the Official Rules or in the event of any dispute between the Entrant and any Third Party Participants or any other person or entity regarding ownership to the Film or any aspect of the Contest, Sponsor reserves the right to disqualify the Entry. Entrants agree to indemnify and hold harmless Contest Entities from and against any and all liability resulting or arising from or in connection with the use of the Film as contemplated herein.

    WINNER SELECTION/NOTIFICATION: Each entrant must comply with all terms and a condition set forth in these Rules, and winning is contingent upon fulfilling all requirements. All entries will be judged and one (1) winner selected on or about November 1, 2008 (the “Judging Date”) by a panel of judges comprised of European travel experts. The judges will score entries based on the following criteria: originality (25%), creativity (25%), and relevancy to topic (25%); suitability for use in trade and advertising (15%); and production quality (10%). The entry with highest overall score will be declared the Winner. In the event of a tie, tying entries will be re-judged based on relevancy to the topic. Selected winner will be notified by e-mail, mail or phone. Phone number will only be used to contact the winner and will not be shared with any third party. In the event that no phone number is provided by entrant and e-mails are returned as undeliverable, Sponsor will attempt to re-send said e-mail up to five (5) times over five (5) days. If any winner does not respond to a phone call notification and/or to said email within five (5) days of its transmission or should the e-mail after five (5) attempts be returned as undeliverable, his or her rights to any prize will be forfeited and the runner up will be selected. Potential prize winners will be required to sign an Affidavit of Eligibility and Liability/Publicity Release (“Release”) within ten (10) days after the notification date, which will require verification of social security number for tax purposes and an IRS Form as well as Evidence of Ownership and Required Permission forms (‘Forms”) from Third Party Participants or others as determined in the sole discretion of the Sponsor. Failure to do so will result in forfeit of all rights to the prize and the selection of an alternate winner. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Contest, including without limitation the execution of required waivers, publicity and liability releases and disclaimers and Forms, such individual will be declared the “winner” of the Contest.

    Winner’s travel companion will be required to sign and return a Liability/Publicity Release prior to travel. Travel companion must be at least 14 years of age at the time of travel and, if a minor, must travel with a parent or legal guardian. If a potential winner or traveling companion is a minor in his or her state of residence the Release must be signed by the winner’s or traveling companion’s parent or legal guardian. Once all documentation is returned to Sponsor and the winner is verified, the prize will be awarded. The Sponsor reserves the right to modify the notification procedures in connection with the selection of alternate winners, if any.

    PRIZE DESCRIPTION: One (1) winner will receive a 7-day package to one of the 38 countries of the European Travel Commission. The package includes roundtrip coach economy air from a major international commercial airport near the winner's primary residence in the US, as determined by the Sponsor, to their choice of any of the 38 European countries for two persons, and one standard hotel accommodations (based on double occupancy) for six (6) nights at a hotel selected by Sponsor. Approximate Retail Value ("ARV") of the prize will vary depending upon the destination selected by winner but cannot exceed 4,000 USD. Actual values may vary based on fluctuations in price for airfare and/or accommodations, and distance between departure and destination. Ground transportation, meals, in-room or other personal charges at lodging (e.g., mini-bar, movies), telephone calls, gratuities, incidentals, and all other expenses are not included and are the sole responsibility of Winner and travel companion. Winner and travel companion must travel on the same itinerary. Prize trip must be taken between December 1, 2008 and May 1, 2009 and may be subject to certain other restrictions, including without limitation, availability and blackout dates. Sponsor will attempt to accommodate winner's preferred itinerary but has no obligation to do so and all specifics thereof will be at Sponsor's sole discretion. Air travel and hotel stay must be prescheduled by the Sponsor at least one (1) month before requested departure date and cannot be modified. Tickets and hotel stays are nonrefundable, nontransferable, and are not valid for upgrades or frequent-flier mileage. Sponsor will not replace any lost, mutilated, or stolen tickets or travel vouchers and is not responsible if the trip is delayed, postponed, or cancelled for any reason. No prize transfer, assignment, or substitution permitted unless stated herein, except the Sponsor may substitute any portion of the prize with something of equal or greater retail value due to unavailability or if Sponsor, in its sole discretion, has security or safety concerns. Winner is responsible for obtaining all necessary travel documentation including Passports and Visas.

    The Winner may choose to receive one (1) $2,000 American Express gift card in lieu of accepting the Trip Prize. Prize cannot be exchanged for cash or changed in any way. Departure and airport taxes, customs/agriculture fees and federal, state, local and other taxes, if any, on prize are not included and are the winner's and travel companion's responsibility. The winner will receive an IRS Form 1099 for the value of the prize. Only after all documentation is returned to Sponsor and the winner is verified will the applicable Trip Prize or gift certificate be awarded. Failure to comply with all terms and conditions may result in forfeiture of the prize

    GENERAL: By participating, entrants and Third Party Participants (and their parents or legal guardians if entrants are minors) agree to be bound by these Official Rules and the decisions of the Sponsor and the judges, which shall be final in all respects. By participating in this Contest and/or by accepting any prize that they may win, entrants agree to release the Contest Entities and their respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; and each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from or in connection with participation in this Contest and/or acceptance or use of any prize. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or documents, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by any prize or resulting from the acceptance, possession or use of such prize, or from participation in the Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest. The Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Contest. The Sponsor may prohibit any entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines an Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or the Contest Entities or their respective representatives. The Sponsor reserves the right in its sole discretion to suspend, modify or terminate this Contest in any manner it deems necessary and reasonable. The Sponsor shall not be responsible if this Contest cannot be implemented or if a prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS CONTEST OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

    DISPUTE RESOLUTION: Except where prohibited, by participating Sweepstakes entrants agree that:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of New York without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of the prize, shall be filed only in the state or federal courts located in the State of New York and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Sweepstakes, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
